Resumen
La sentencia definitiva de la Corte Interamericana de Derechos Humanos no implica la finalización del conocimiento del caso por parte del Sistema. A lo largo de los años, la Corte ha venido consolidando un mecanismo de seguimiento y supervisión del cumplimiento de sus fallos, creando formas de relacionamiento directo con distintos órganos de los Estados parte. Este artículo se propone contribuir a una mejor comprensión de esta fase del proceso interamericano, evaluando el impacto transformador que pueden producir las interacciones. Al realizar un estudio del grueso de las resoluciones que contienen órdenes relativas al legislativo, se identificaran efectos transnacionales con relación a la violencia de género y el feminicidio, la desaparición forzada y la tortura, delitos asociados al terrorismo y traición a la patria y la de injuria y calumnia. A partir de esta propuesta de análisis y desde el constructivismo, se busca verificar en los países miembros del sistema los impactos del procedimiento de supervisión a nivel normativo en su ordenamiento interno, ello sin dejar de lado los efectos directos de las decisiones y la verificación del cumplimiento de las mismas.
Abstract
The final sentence of the Inter-American Court of Human Rights does not imply the conclusion of the case's consideration by the System. Over the years, the Court has been consolidating a mechanism for monitoring and supervising compliance of their judgments creating forms of direct interactions with different State bodies and institutions. This article aims to contribute to a better understanding of this phase of the inter-American process by evaluating the transformative impact that these interactions can produce. By conducting a study of the bulk of the resolutions containing orders related to the legislative branch, will be identified transnational effects concerning gender-based violence and femicide, forced disappearance and torture, crimes associated with terrorism and treason, as well as defamation and slander. Based on this proposed analysis from the constructivist perspective, the goal is to verify in the member countries of the System the normative impacts of the supervision procedure on their internal legal frameworks, while not overlooking the direct effects of the decisions and the verification of compliance with them.
